The products provided to you by us cannot be transferred or used by anyone other than you.Some imagery, used in our products are obtained from varies third parties with a Limited Usage License. This gives you the right to use these images only as a part of the website we build for you. Any kind of separate usage or distribution is prohibited. ETF Solutions will not be held responsible for any inaccuracy or legality of any information provided on any site it designed or maintains. An ETF Solutions link will placed on every site it produces. All maintainance and any other web site related work will be charged at a hourly rate, except for quoted jobs. ETF Solutions will not be held responsible for the failure of any site caused by outside entities. ETF Solutions will not be held responsible for loss of income, data or any other potential losses that may arise from use of the web site.

All Domains that are purchased through ETF Solutions will have will have the Domain Name Servers set to those of ETF Solutions.
The domain name servers can be changed after 12 months, by making a request using our online ticket support system.
To be eligable for an Australian .au domain name there are terms and conditions that must be met. Below is an abbreviated list,

com.au - For commercial entities, such as companies (with ACN as registered through ASIC), and businesses (registered with state governments).

net.au - For commercial entities, such as companies (with ACN as registered through ASIC), and businesses (registered with state governments).

org.au - For non-commercial organisations.

id.au - For individuals who are Australian citizens or residents.

asn.au - For non-commercial organisations.

All services provided by ETF Solutions may only be used for lawful purposes. You agree that until you notify ETF Solutions of your desire to cancel any or all services received, those services will be billed on a recurring basis. Any invoice that is overdue by 14 days or more and not paid will result in a late fee and/or an account suspension until account balance has been paid in full. ETF Solutions reserves the right to change pricing of hosting plans and any other charges at anytime. ETF Solutions is not responsible for files and/or data residing on your account. ETF Solutions reserves the right to cancel the account at any time with or without notice. You will be allocated a monthly bandwidth allowance, which varies depending on your hosting package. Should your account exceed the allocated amount, we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account. Any unused allowance in one month cannot be carried over to the next month.

Customer agrees that it shall defend, indemnify, save and hold ETF Solutions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against ETF Solutions, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ETF Solutions against liabilities arising out of;
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with ETF Solutions;
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
(3) copyright infringement and
(4) any defective products sold to customers from ETF Solutions's server.
ETF Solutions shall not be responsible for any damages your business may suffer. ETF Solutions makes no warranties of any kind, expressed or implied for services we provide. ETF Solutions disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by ETF Solutions and its employees. ETF Solutions reserves the right to change or update it's terms and conditions and policies without notice.
